IUS/08 - CONSTITUTIONAL LAW

Learning outcomes

The course aims at giving students the basic tools to comprehend the constitutional legal methodology in relation to the sources of law (basic level), the form of Italian government, the structure of the Constitution and of the provisions thereof. The course's goal is to offer to students the knowledge required to be aware of their rights/duties as citizens and to understand the dynamics of the public decision-making processes. At the end of the course, students shall be able to interpret the provisions of the Italian Constitution, to deal with juridical questions by adopting a Constitution-oriented approach and to solve basic applicative issues related to the sources of law. Students shall also be able to autonomously form their opinions on public facts connected to the constitutional law

Program

The course is divided into two parts

Part I
The subject of the first part is the study of the sources of law. It examines: the sources of law in general; the individual sources of Italian law (constitutional, primary, secondary and regional sources); international and foreign sources that produce effects in the Italian legal system; European sources.

Part II
In the second part of the Course the following will be studied:
Structure of the Italian form of government.
Constitutional regulation of fundamental rights.
Protection of fundamental rights.
System of constitutional justice

Examination Methods

The examination is oral and tests theoretical and practical knowledge of the institutes covered by the programme. Reasoning ability is an essential part of the assessment.
